The implementation of social rights as an instrument of criminal prevention in the Democratic State of Law

Given the high crime rate in Brazil, the objective is to analyze the social factors of crime, the effective implementation of social rights as an instrument of criminal prevention and punitive selectivity.Therefore, through a deductive method, supported by bibliographic review and statistical analysis technique, an analysis of criminality is carried out from the theoretical and legal point of view, from which it can be observed that the realization of social rights requires greater efforts on the part of the State, in order to avoid the incidence of punitive selectivity, high crime rate and imprisonment, and to promote the social well-being that the Democratic Rule of Law deals with.
