Mistreatment of companion animals: a reflection based on Law 14.064/2020

This article aims to reflect on Law 14.064/2020, which increased penalties for mistreatment of dogs and cats and prohibited the custody of these animals in cases of conviction. Throughout history, animal rights have evolved, culminating in this law. The original bill was modified to focus on dogs and cats due to their status as companion animals and their strong presence in Brazilian households. The creation of this legislation was driven by the frequent cases of mistreatment in the country, as well as the recognition of animal sentience, which reinforces the idea that animals are rights-bearing beings. This research uses the deductive method, based on the premise that Law 14.064/2020 plays an important role in recognizing the need for appropriate punishment for the crime of mistreatment. It concludes that although Law 14.064/2020 is limited in scope, it represents a significant advance. Studies linking domestic violence and animal abuse highlight the importance of laws that punish cruel acts, giving the law both punitive and preventive characteristics. Furthermore, it may signify progress towards other protective legislation for Brazilian wildlife.
