Abstract

The phenomenon of statelessness, which means the absence of a homeland, characterizes individuals with no nationality bond with any State. Although little discussed, it is a problem that affects people to this day on a universal scale. This work aims to approach the issue by exposing its main causes and consequences, dealing with issues about statelessness in the face of the protection of human rights, and emphasizing the importance of nationality, as well as the consequences that this phenomenon brings to the individual in a society. It is known that nationality is a form of legal bond with a State, so people recognized as stateless or “without a homeland” do not have any identification document. The objective of this assignment, after identifying its causes and consequences, is to analyze the possibility of deporting people with stateless status from the Brazilian territory, as they do not have any document or regularity to remain in the country. The research method adopted for this article is deductive, as it results from extensive bibliographical research, real cases, conventions and legislation, identifying some situations that contribute to the occurrence of the phenomenon of statelessness, based on analysis of general laws applied to specific cases of stateless. As a possible conclusion to the theme, there is the hypotheses of permanence in national territory for the protection of Human Rights and Conventions, or deportation due to lack of documents and for not having Brazilian nationality.
