The (in)fallibility of recognition people from the perspective of false memories

This article deals with the recognition of people as a kind of evidence in criminal proceedings and the possible problem generated by the phenomenon of false memories. Fot this, the evidence will be analyzed, which are of paramount importance, because it has the power to influence the conviction of the magistrate, for this reason, there is in the Brazilian legal system a specific chapter for the evidence, comprising articles 155 to 250 of the code of criminal procedure. Among the various types of evidence admitted, this article aims at one in particular, the recognition of people. That said, the objective of the study is to understand the human mind and the way that false memories influence the testimonial evidence of criminal proceedings, through research in doctrinal books, articles, specialized magazines and journals, characterizing an exploratory, qualitative, bibliographic review research.
