A brief analysis of the Henry Borel Law and the Maria da Penha Law in a comparative bias

This work aims to carry out a brief analysis of Law n.º 11.340/2006 (Lei Maria da Penha) and Law n.º 14.344/2022 (Lei Henry Borel) regarding domestic and family violence, on the emergency protective measures and the crimes foreseen in the referred laws, in order to point out the main similarities and differences between the laws. The methodology used is exploratory in nature and supported by a literature review. After the analysis, it was possible to conclude that the Lei Henry Borel, although it is very similar to the Maria da Penha Law in several devices, is also, in a certain way, more protective in the formal aspect. In addition, the Lei Henry Borel began to penalize the conduct of those who know about violence but do not communicate it, as this criminal type is the main legislative novelty that deserves close attention.
