Abstract

Due to the enormous demand on the Judiciary, which ends up resulting in the accumulation of countless processes, as well as the slowness of their solutions, it has become essential to seek other alternatives that will help resolve these problems. Thus, it is observed that the New Code of Civil Procedure ended up addressing conciliation and mediation, highlighting such means as methodologies that provide a consensual solution to conflicts. Considering this, the proposed research aims to answer the following problem question: have family constellations proven to be effective as an alternative method of resolving conflicts in family law? The general objective of the study was to study Family Constellation as an alternative method for resolving conflicts in Family Law. Methodologically, the study was comprised of bibliographical, documentary research and deductive method. The results found sought to elucidate the Family Constellation within Systemic Law sought in certain Courts of Justice, to contribute to the Judiciary to reduce the overload of processes in the area of Family Law, as well as, promoting a harmonious and peaceful conflict solution to those under jurisdiction. It is concluded that, given the use of Family Constellation in legal demands, it is supported by Resolution No. 125/2010, of the National Council of Justice. Therefore, seeking to provide means for consensual solutions in conflicts in Family Law, within this methodology it is possible to highlight positive points in relation to controversies in the face of the conflict, which results in the plaintiffs favoring a peaceful solution.
