Abstract

The responsibility to provide maintenance and the need to be maintained can cross borders, after all, considering the increase and mobility of people, there are countless families in which one of them lives in a different country. Therefore, there is a need to create cooperative international mechanisms to regulate the relationships of people who do not live in the same country, especially in the Families Law and the theme of maintenance. In this perspective, as the research is focused on the study of the provision of maintenance in different countries, the article aims to expose the three main conventions that Brazil is one the party and aims to show its general concepts. There are: (1) Convention of the United Nations (UN) on the provision of maintenance abroad or the New York Convention; (2) Inter-American Convention on Maintenance Obligations; (3) Convention on the International Recovery of Maintenance to Children and Other Family Members or The Hague Convention. The methodology applied in this research is qualitative, with the deductive method, using a bibliographic review. At the end, the main treaties- legal aspects are highlighted.

    Possui graduação em Direito pela Pontifícia Universidade Católica do Paraná-PUCPR (2012) e graduação em Relações Internacionais pela UNINTER (2012-2015). Mestre em Direitos Fundamentais e Democracia no Centro Universitário Autônomo do Brasil - UNIBRASIL (2015-2017). Atualmente é Professora da Unc - Universidade do Contestado. Participou da École D'été en Relations Internationales sur les conflits et les interventions internationales em Bordeaux, França (2017), sobre conflitos internacionais e intervenções. Realizou estudos na Corte Internacional de Justiça - Académie de Droit International de La Haye (2017).
