Infiltration of police agents in law 12.850 and its importance in the fight against criminal organizations

This research makes an analysis about the infiltration of agents in Brazil, especially after the edition of the Criminal Organizations Law - Law 12.850, and intends to examine the circumstances and difficulty involving its exercise, demonstrating the importance of this means of obtaining evidence against organized crime. The work uses the structuralist method, with a phenomenological approach, and while the research technique, bibliographic and legislative documentation. In the first part of the work, observes the historical emergence of organizations and their development in Brazil. Then, it analyzes the institute of infiltration of agents, in its legal and practical aspects. In the third chapter, addresses about the challenges in combating organized crime, and the importance of action by the government and law enforcement agencies in the dismantling of these criminal corporations, also indicating the relevant role of civil society in this scenario. Finally, it concludes on the importance of the new instrument of infiltration of agents in the investigation of criminal organizations, and how it should be used with accuracy and police expertise, also indicating the need for resources and qualified human resources to be executed in the best way, in order to protect society and the democratic rule of law.
