LGPD: a fundamental pillar for preventive legal management in companies

This article analyzes the Brazilian General Data Protection Law (LGPD) as an essential pillar for preventive legal management in companies, highlighting its importance in protecting privacy and the security of personal data within the Brazilian business context. The main objective is to examine the LGPD as a strategic tool in preventive legal management in organizations, focusing on its impacts on organizational compliance, risk mitigation, and the protection of personal data. The research, based on an inductive approach, combined bibliographic and documentary methods, with a detailed analysis of legislation and legal doctrine. The results show that the LGPD imposes strict guidelines that organizations must adopt to ensure responsible data processing, such as internal policies, risk mapping, employee training, and the role of the Data Protection Officer (DPO). Preventive legal management emerges as a strategic tool to anticipate legal issues, reduce the risk of sanctions, and promote an organizational culture oriented toward compliance. The study also emphasizes that complying with the LGPD goes beyond a mere legal obligation, constituting a competitive advantage that strengthens institutional reputation and enhances consumer trust. It concludes that the LGPD is an indispensable foundation for creating safer, more ethical, and more responsible business environments, contributing to business sustainability and the effective protection of data subjects’ fundamental rights.
